TERMS OF USE

1. ABOUT SIMULTAP

SimulTap is a multi-touch memory game for iOS that challenges your coordination and memory through progressive tap sequences. SimulTap does not upload, transmit, sync, or share your gameplay data or any personal data to any server or cloud service without your consent. Your game progress and preferences remain entirely on your local device.

2. LICENSE GRANT

Subject to your acceptance of these Terms and payment of any applicable fees, Matchi Inc grants you a limited, non-exclusive, non-transferable, revocable license to install and use the SimulTap application on your iOS device(s) for your own personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, or sublicense the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without prior written consent from Matchi Inc
• Remove or alter any proprietary notices, labels, or marks on the App

3. FREE TRIAL

SimulTap offers a free trial period upon first installation. During the trial period, you have full access to all features of the App at no charge.

At the end of the trial, continued use of the App requires a paid license. If you do not purchase a license, access to premium features will be restricted after the trial period expires. We do not require payment information to start a free trial.

4. PAYMENT & PRICING

After the free trial, access to SimulTap's full feature set requires purchase of a paid license. All prices are displayed at the time of purchase. Payments are processed securely through the App Store or Stripe. By completing a purchase, you authorize us to charge the applicable fee to your payment method.

All fees are in US Dollars unless otherwise stated. We reserve the right to change pricing at any time; however, any pricing change will not affect licenses already purchased.

5. REFUND POLICY

We offer a 30-day money-back guarantee from the date of purchase, subject to the conditions below. We want you to be satisfied, but we have established this policy to be fair to all customers while protecting against abuse.

5.1 Eligibility for a Refund

You may request a refund within 30 days of purchase if:

• The App does not function as described on our website due to a defect or error on our part
• You experience a technical issue that our support team is unable to resolve within a reasonable timeframe
• You purchased the App by mistake and have not used it beyond initial installation

5.2 Refund Exclusions

Refunds will not be issued in the following circumstances:

• You have used the App beyond the free trial and for more than 7 days after purchase
• You request a refund solely because you changed your mind after active use
• You have already received a refund for a previous SimulTap purchase
• Your request falls outside the 30-day window from the date of purchase
• The issue is caused by your device, operating system incompatibility, or third-party software — not by the App itself
• You violated these Terms of Use

5.3 How to Request a Refund

To request a refund, email us at simultap@gmail.com with the subject line "Refund Request" and include:

• Your full name and email address used at purchase
• Date of purchase and order/receipt number
• A brief description of the issue or reason for the refund request

We will review your request and respond within 5 business days. Approved refunds will be returned to your original payment method. Matchi Inc reserves the right to deny refund requests that do not meet the eligibility criteria above.

6. INTELLECTUAL PROPERTY

The App, including all code, design, graphics, logos, and documentation, is the exclusive intellectual property of Matchi Inc and is protected by copyright and other applicable laws. These Terms do not grant you any ownership rights in the App. "SimulTap" and the SimulTap logo are trademarks of Matchi Inc. You may not use them without our prior written permission.

7. YOUR DATA & PRIVACY

SimulTap operates primarily on your local device. The App does not access, collect, transmit, or store any of your personal files on our servers. The only data we may collect is what is necessary to process your payment (handled by Stripe or the App Store) and to respond to support requests.

8. NO WARRANTY / DISCLAIMER

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be error-free or uninterrupted
• The App will be compatible with all operating systems or hardware configurations
• Any errors in the App will be corrected

You use the App at your own risk. Matchi Inc is not responsible for any loss of data, however caused.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATCHI INC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

IN NO EVENT SHALL MATCHI INC'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. UPDATES & CHANGES TO THE APP

We may release updates, patches, or new versions of the App from time to time. Updates may be required to continue using the App. We reserve the right to modify, suspend, or discontinue any feature or the App itself at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

11. CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. GOVERNING LAW & DISPUTES

Matchi Inc is a corporation incorporated in the State of Delaware, United States. These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Nothing in these Terms limits any rights Matchi Inc has under the laws of the State of Delaware with respect to its corporate governance and internal affairs.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved informally by contacting us at simultap@gmail.com. If the dispute cannot be resolved informally within 30 days, it shall be subject to binding arbitration in Oceanside, New York, under the rules of the American Arbitration Association.

13. TERMINATION

We reserve the right to terminate or suspend your license to use the App immediately, without prior notice or liability, if you breach any provision of these Terms. Upon termination, your right to use the App will cease immediately.
